(A) Before a restaurant wine license is issued, the applicant must:
(1) Be the owner or lessee of a restaurant which receives 50% or more of its gross annual income from the sale of food; and
(2) Have a minimum seating capacity of 50 people at tables.
(B) The license shall be subject to any additional requirements imposed by the Alcoholic Beverage Administrator of the city, the state’s Alcoholic Beverage Control Commission or state regulations.
