(A) In order to secure a license, the applicant must present the following to the local Alcoholic Beverage Commissioner:
(1) A valid existing state license for the retail sale of liquor and wine by the drink;
(2) Proof that the premises licensed shall contain facilities for the service of food to no less than 20 patrons seated at tables or counters;
(3) Proof that the premises shall contain adequate kitchen and storage facilities for the preparation of food to be served upon the premises and that the kitchen facilities are separated from the serving area; and
(4) Proof that the applicant has employed on the premises no less than one person whose sole responsibility shall be the preparation of the food in the kitchen facilities for the purpose of sale of food and meals upon the premises.
(B) The license issued by the city shall not be transferable.
