§ 110.04 FEES.
   (A)   The license fee herein levied shall be due on July 1 each year, unless otherwise stated; except that, persons commencing or desiring to operate a trade, business, occupation or profession for only part of a license year, and having sales of less than the sum of $500, after July 1 of each license year shall pay a prorated fee, except as otherwise specifically proved here, equal to as many twelfths of the annual license fee as there are calendar months remaining in the license year, including the month in which the license is granted. Persons who cease business during the license year shall be entitled to a refund of the license fee only if there is more than six months remaining in the license year and the licensee advised the City Clerk at 634 Conestoga Parkway, Shepherdsville, Kentucky 40165 in writing at least 30 days prior to the cessation of business as to the intention to close permanently. The license fee refund, if the notice is given, shall be prorated equal to as many twelfths of the annual license fee as there are calendar months remaining in the license year.
   (B)   The following fees shall be paid by a person conducting or engaged in the following business, occupations or professions.
      (1)   Group I. Alcoholic Beverages, Sale of.
         (a)   Liquor dealers holding a state retail package liquor license: $400;
         (b)   Alcoholic beverage dealer who holds a state distributors or wholesaler’s or brewer’s license, making sales or deliveries in the city: $200; and
         (c)   Malt beverage dealer holding a state retail license: $200.
      (2)   Group II. Amusement. Distributing/servicing/operating coin-operated amusement machines (e.g., nickelodeons and music machines): $10/per machine;
      (3)   Group III: Fireworks Stands.
         (a)   For purposes of this division (B)(3), the term FIREWORKS is as defined in KRS 227.702.
         (b)   Each individual or entity desiring to sell fireworks within the city on a temporary basis shall obtain a temporary business license from the city’s Government Center. Said individual or entity shall complete an application and shall state thereon the dates of operation of the temporary business. Temporary businesses selling fireworks may operate for up to 14 days. Any structure erected for the sale or storage of fireworks on a temporary basis must be removed within three days of the closure of the temporary business.
         (c)   The fee for said temporary license shall be $1,000 to be used for fire prevention and education.
         (d)   No license shall be issued by the city until all necessary inspections are complete and proof of compliance has been provided to the city.
         (e)   No license shall be issued until proof of liability insurance of at least $1,000,000 has been obtained and provided to the city by all temporary businesses selling fireworks.
         (f)   Each temporary business selling fireworks shall provide visibly marked parking, including handicapped accessible parking if otherwise required by law. Said required parking shall comply with the county’s planning and zoning regulations.
         (g)   Each temporary business selling fireworks shall submit a site plan to the city’s Fire Department with dimensions stated thereon showing parking and proximity to other structures.
         (h)   Each temporary business selling fireworks shall abide by the regulations of the current edition of the National Fire Protection Association 1124 (NFPA 1124) in relation to distance between fireworks location and other structures.
         (i)   All temporary businesses selling fireworks shall at all times have posted signs prohibiting smoking on site and prohibiting the discharge of any explosive or fireworks on site. At least one sign shall be posted on each side of the structure or lot wherein hazardous materials are stored.
         (j)   Temporary businesses selling fireworks shall be exempt from remitting occupational withholding tax to the city.
         (k)   All persons working at a temporary business selling fireworks shall be at least 18 years of age or older; except that, minors may work in said business if said minor is the child of the owner or manager of the business and works under his or her direct supervision.
         (l)   No fireworks may be sold to anyone under the age of 18.
         (m)   Any electrical work done on the premises of a temporary business selling fireworks shall be done to current code and must comply with all state, federal and local laws.
         (n)   No person shall sleep in a tent or in the open on the site of a temporary business selling fireworks.
      (4)   Group IV. All Other Businesses. All other businesses not being included in Group I, Group II or Group III shall pay a license fee of $100 per year.
