§ 35.18 RECOMMEND FEES.
   (A)   Any fees charged by a wrecker service currently on the city’s Police Department wrecker service rotation list which exceed the recommended fees listed below shall cause the use of the wrecker service on the rotation list to be reevaluated by the Code Enforcement Officer.
   (B)   The stated fees do not include special services including, but not limited to: winch charges; rollovers; the use of fire extinguishers; and cleanup (other than general debris), which may be charged on non-standard tows.
   (C)   For the purpose of this section, the following definitions apply unless the context clearly indicates or requires a different meaning.
      NON-STANDARD TOW. Any tow that requires additional services above those performed on a standard tow.
      STANDARD TOW. Any tow of a vehicle that does not require any special services other than towing.
   (D)   (1)   All standard tows (non-accident), Monday through Friday, 8:00 a.m. to 6:00 p.m.: $65;
      (2)   All standard tows (non-accident), nights and weekends: $75;
      (3)   Accident related tows (non-standard) may be charged additional fees according to the work performed. The additional fees must be clearly documented and explained on the tow ticket. Fees must not be excessive for the work performed:
         (a)   Dollies: $30; and
         (b)   Storage of all vehicles outside per day: $15:
            1.   Inside storage per day: $20;
            2.   No keys: $20; and
            3.   Labor rate per hour: $60.
      (4)   An additional one-time fee of $10 may be charged for those vehicles that require the need of inclement weather covering (tarp);
      (5)   Large wrecker: $350;
      (6)   Large wrecker tows may be charged additional fees. The additional fees must be clearly documented and explained on the tow ticket. Fees must not be excessive for the work performed;
      (7)   Stand-by time: occasionally wreckers are called to scene and are required to sit idle until utilized. Wrecker services are here by authorized to charge an hourly fee for such stand-by time. This hourly rate may not exceed the standard tow charge (non-accident) rate of $65; and
      (8)   After hour release of stored vehicles: after a vehicle is placed in the company’s storage area and a request is made for its release, the wrecker service may charge a maximum of $50 to reopen the business and release the vehicle, only if the request occurs between the hours of 6:00 p.m. to 8:00 a.m. and there was no employee at/on the premises to release the vehicle at the time of the request.
   (E)   The rates and charges as established herein do not relate to or regulate consensual wrecker services, being those situations where the vehicle’s owner expressly requests towing or wrecker services by a specific towing company and enters into a private contract with the towing or wrecker company for services.
   (F)   There will be no winching charges for normal loading of a vehicle onto a rollback.
   (G)   The above rates shall automatically increase 3% each year from the prior years’ rates effective January 1 of each year. Such automatic increase shall begin 1-1-2011.
