§ 53.024 LOITERING
   (A)   It shall be unlawful for any person within the city limits to violate any of the following subsections of this section:
      (1)   No person shall loiter or remain in a public place for the purpose of unlawful gambling, except that the provisions of this subsection shall not apply if the person is participating in charitable gaming defined by KRS 238.505.
      (2)   No person shall loiter or remain in a public place for the purpose of unlawfully using a controlled substance.
      (3)   No person shall loiter or remain in any public place with intent to obtain money from other persons by any illegal or fraudulent scheme, trick, artifice, or device.
      (4)   No person shall occupy, lodge or sleep in any vacant or unoccupied barn, garage, shed, shop, or other building or structure, or in any automobile, truck, railroad car, or other vehicle, without owning it or without permission of the owner or person entitled to possession of it, nor lodge or sleep in or on a public roadway outside of an enclosed vehicle. Further, no person shall lodge or sleep in any vacant lot or alley, or in or on a public roadway inside of an enclosed vehicle that is not obstructing traffic, or on any sidewalk, or in any public park without authorization, or on any other public property reasonably visible to public view for an unreasonably protracted period of time.
   (B)   In addition to any civil penalties allowed under § 53.999 of this Chapter 53, any person who violates any subsection of this § 53.024 may be charged with criminal penalties in accordance with the provisions of the Kentucky Revised Statutes.
