§ 41.032 PROTECTION OF ADJOINING PROPERTY
The person giving notice shall at all times and at his own expense preserve and protect from injury any adjoining property by providing proper foundations and taking other measures suitable for the purpose, including, but not limited to, shoring up and protecting all buildings, walls, fences, or other property likely to be damaged during the facility work. All facility work must be conducted and facilities located so as to cause minimum interference with the rights and reasonable convenience of property owners. The city may from time-to-time issue such reasonable rules and regulations concerning the installation and maintenance of the facilities installed in the public way as may be consistent with this chapter. Whenever it may be necessary to trench through any lawn area on public or private property, that area shall be reseeded or the sod shall be carefully cut and rolled and replaced after ditches have been backfilled as required by this chapter. All construction and maintenance work shall be done in a like manner calculated to leave the lawn area clean of earth and debris and in a condition as nearly as possible to that which existed before the work began. A utility may trim trees within the public way at its own expense as necessary to protect its wires and facilities, subject to any direction and consent provided by the Director of Public Works/City Engineer. Trees on private property may be trimmed with the consent of the property owner.
