§ 41.001 PERMIT REQUIRED FOR DRIVEWAY CONSTRUCTION, ALTERATION
   (A)   No person, firm, or corporation shall construct or alter any driveway or entrance upon any public street or alley of the city without first obtaining written consent to do so from the Director of Public Works/City Engineer. Any person, firm, or corporation desiring to construct or alter any driveway or entrance way upon the public streets or alleys of the city shall make written application for permission to do so by writing directly to the Director of Public Works/City Engineer, outlining in detail the exact plan of the proposed construction or alteration. The application shall be accompanied by a fee of twenty-five dollars ($25.00). The proposed new construction or alteration of existing constructions shall be planned and done in such a manner as not to damage the public streets or alleys and so as not to interfere with the proper drainage of surface waters along the streets and alleys. No construction or alteration shall be permitted which will be done in such a manner as to damage the public streets or alleys of the city. The standard for construction or alteration of entrance ways or driveway shall be according to the prevailing standards of the Kentucky Department of Highways for entrance ways upon the public roads of the state. The Director of Public Works/City Engineer shall not arbitrarily withhold permission for any proposed construction or alteration which meets the standards.
   (B)   No contractor, or other person, firm, or corporation performing for any individual or firm or corporation shall proceed to construct or alter any entrance or driveway upon any of the public streets or alleys of the city without first ascertaining that the permission required under this chapter has been obtained.
