§ 130.02 DEFACING PUBLIC OR PRIVATE PROPERTY.
   (A)   It shall be unlawful for any person to deface, deform, or mar any public or private building, or the surface of any tree, lamppost, telegraph pole, telephone pole, hydrant, bridge, pier, sidewalk, street, or alley, or to cause the defacing, deforming, or marring of the surface of any public or private property located upon any public thoroughfare or right-of-way, or any public place within the city. However, this section shall not prohibit the posting of notices required by law to be posted.
   (B)   It shall be unlawful for any person to deface, deform, or mar or to cause the defacing, deforming, or the marring of the surface of any privately-owned wall, window, door, gate, fence, advertising board or sign, or any other publicly or privately owned building or structure within the city, unless he or she is the owner thereof, or has secured in writing the consent of the owner, lessee, or tenant.
