3-2-11: BEER, PURCHASE/SALE BY RETAILER:
   A.   Purchase: It is unlawful for a licensed retailer to purchase or acquire beer from anyone except a brewer or wholesaler licensed under the provisions of the Montana alcoholic beverage code.
   B.   Restrictions On Sale: It is unlawful for any brewer, wholesaler or retailer, or his or her employee or employees to sell, deliver or give away, or cause or permit to be sold, delivered or given away, any beer to: (1975 Code § 5.08.190)
      1.   Any person under the age of twenty one (21) years; (1975 Code § 5.08.190; amd. 2008 Code)
      2.   Any intoxicated person or any person actually, apparently or obviously intoxicated. (1975 Code § 5.08.190)
   C.   Sell Or Serve For Consumption On Premises: It is lawful for such retailer to sell and serve beer either on draft or in containers to the public to be consumed on the premises of such retailer. (1975 Code § 5.08.200)
   D.   Sell For Consumption Off Premises: It is lawful for such retailer to sell or furnish beer to the public with intent that such beer shall be taken away from the premises of such retailer for consumption off the premises of such retailer. (1975 Code § 5.08.210)
