2-2-2: MEMBERSHIP:
   A.   Appointment: The city-county planning board shall consist of not less than nine (9) members to be appointed as follows:
      1.   Two (2) official members who reside outside the city limits but within the jurisdictional area of the city-county planning board to be appointed by the board of county commissioners, who may, in the discretion of the board of county commissioners, be employed by or hold public office in the county.
      2.   Two (2) official members who reside within the city limits to be appointed by the city council, who may, in the discretion of the city council, be employed by or hold public office in the city.
      3.   Two (2) citizen members who reside within the city limits to be appointed by the city mayor.
      4.   Two (2) citizen members who reside within the jurisdictional area of the city-county planning board to be appointed by the board of county commissioners.
      5.   The ninth member to be appointed by the board of supervisors of a conservation district provided for in Montana Code Annotated section 76-15-311 from the members or associate members of the board of supervisors, subject to approval of the members provided for in subsections A1 through A4 of this section.    B.   Terms: As soon as the city council has enacted the ordinance codified in this chapter, creating the city-county planning board, the city council shall elect a member of its body to serve on the planning board. The terms of the members who are officers of the city or county represented on the board shall be coextensive with their respective terms of office to which they have been elected or appointed; the terms of the other members shall be two (2) years, except that the terms of the first members appointed shall be fixed by agreement and rule of the governing bodies represented on the board for one or two (2) years in order that a minimum number of terms shall expire in any year.    C.   Vacancy: The city council shall fill any vacancy occurring in its respective membership on the planning board. (1975 Code § 2.20.040)
   D.   Certification: The financial officer shall certify members appointed by its body. The certificates shall be sent to and become a part of the records of the city-county planning board. The mayor shall make similar certification for the appointment of citizen members. (1975 Code § 2.20.050)
   E.   Citizen Members; Qualifications: The citizen members shall be qualified by knowledge and experience in matters pertaining to the development of the city, and shall hold no other office in the city government, and shall be resident freeholders of the city.    F.   County Representative: As soon as the city council has enacted the ordinance codified in this chapter creating the city-county planning board, the board of county commissioners shall, within forty five (45) days, designate a representative of the county, which representative may be a member of the board of county commissioners or an office holder or employee of the county, to the mayor for appointment to the planning board; in the event of the failure of the county to designate such member, the mayor may appoint a person of his choosing and at his sole discretion as a representative of the county.
