12-8-14: UTILITIES:
The subdivider must provide adequate and appropriate easements for the construction and maintenance of utilities within the subdivision. The subdivider must obtain any easements necessary to extend utilities to the subdivision.
   A.   Utility Lines: Where practical, overhead utility lines must be located at the rear property line. If possible and practicable, utilities shall be placed underground.
   B.   Utility Facilities: Utility facilities must be designed by utility firms in cooperation with the subdivider. These facilities are subject to all applicable laws, rules, and regulations of any appropriate regulatory authorities.
   C.   Easements:
      1.   Location: Utility easements located between adjoining lots must be centered on lot lines. If easements are placed in the street, they must be located between the roadway and the right of way line.
      2.   Width: Utility easements must be fifteen feet (15') wide unless otherwise specified by a utility company or governing body.
   D.   Notice Of Utility Occupancy: When a utility is to be located in an existing, dedicated right of way, a notice of utility occupancy must be obtained from the governing body or state highway department.
   E.   Language Required On Final Plat: In addition to showing the location of utility easements on the plat with dashed lines, the following statement must appear on the final plat:
The undersigned hereby grants unto each and every person, firm, or corporation, whether public or private, providing or offering to provide telephone, telegraph, electric power, gas, cable television, internet, water or sewer service to the public, the right to the joint use of an easement for the construction, maintenance, repair and removal of their lines and other facilities, in, over, under and across each area designated on this plat as "Utility Easement" to have and to hold forever.
