Any individual, person, partnership, and/or corporation and/or private or business entity of any kind found to be in violation of this chapter shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not less than fifty dollars ($50.00) nor more than one hundred dollars ($100.00), plus any applicable surcharge, for each such offense. In the event the Shelby fire department incurs any expenditure related to an unlawful open burn, the judge may also assess such costs. (Ord. 732, 4-20-1998, eff. 5-20-1998)
