5-2-1: CURFEW; LOITERING:
   A.   Prohibited: It is unlawful for any parent, guardian or person having custody of a minor to permit such minor to be upon any public street, thoroughfare, avenue or alley or in any public place or other place without acceptable supervision under the following conditions:
      1.   Minors Under Twelve: The curfew for a minor under the age of twelve (12) years shall be:
         a.   Weekdays: On weekdays, the hours from ten o'clock (10:00) P.M. in the evening until five o'clock (5:00) A.M. the following morning, beginning Sunday evening and including Monday, Tuesday, Wednesday, Thursday and ending at five o'clock (5:00) A.M. on Friday morning;
         b.   Weekends: On weekends, from eleven thirty o'clock (11:30) P.M. on Friday evening until five o'clock (5:00) A.M. on Saturday morning, and from eleven thirty o'clock (11:30) P.M. on Saturday evening until five o'clock (5:00) A.M. on Sunday morning.
      2.   Minors Twelve But Under Eighteen: The curfew for a minor twelve (12) years of age, but under the age of eighteen (18) years shall be:
         a.   Weekdays: On weekdays, the hours of eleven o'clock (11:00) P.M. in the evening until five o'clock (5:00) A.M. the following morning, beginning Sunday evening including Monday, Tuesday, Wednesday, Thursday and ending at five o'clock (5:00) A.M. on Friday morning;
         b.   Weekends: On weekends, from one o'clock (1:00) A.M. to five o'clock (5:00) A.M. on both Saturday and Sunday mornings. (1975 Code § 9.68.010)
   B.   Exceptions: The provisions of subsection A of this section do not apply to a minor accompanied by his or her parent, guardian or other adult person having the care and custody of the minor, or where the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian or other adult person having the care and custody of the minor.    C.   Responsibility Of Parents: It is unlawful for the parent, guardian or other adult person having the care and custody of a minor child as defined in subsection A of this section to knowingly permit such minor to loiter, idle, wander, stroll or play in or upon the public streets, avenues, thoroughfares, alleys or in any public place, or other place, between the hours as defined in subsection A of this section.    D.   Duty Of Law Enforcement Agency: It shall be the duty of the law enforcement agency of the city to apprehend and take into custody any minor found in violation of this section. Any minor violating the provisions of this chapter shall be dealt with in accordance with the juvenile laws of the state. (1975 Code § 9.68.040)
   E.   Penalty: Any parent, guardian, or other adult person having the care and custody of a minor violating the subsections of this section shall be subject to penalty as provided in section 1-4-1 of this code. (1975 Code § 9.68.050; amd. 2008 Code)
