§ 1040.99 PENALTY.
   (a)   Whoever violates any of the provisions of this chapter, for which no penalty is otherwise provided, is guilty of a minor misdemeanor for a first offense and shall be fined not more than $100. For any subsequent offense the person is guilty of a misdemeanor of the fourth degree and shall be fined not more than $250 or imprisoned not more than 30 days, or both. A separate offense shall be deemed committed each day during or on which a violation occurs or continues. In addition, the offender shall be liable for any damage, destruction or cost incurred by the city because of the offense.
   (b)   Whoever violates § 1040.06 is guilty of a misdemeanor of the third degree and shall be fined not more than $500 or imprisoned not more than 60 days, or both.
