§ 1020.01 PERMIT REQUIRED; APPLICATION; BOND.
   Any person who desires to make an opening in the pavement of any street, alley, avenue or public grounds, improved with brick, asphalt, wood block, stone block or macadam, shall make a written application to the Mayor for a permit to open the improved street, alley, avenue or public grounds. The application shall set forth the location, kind and extent of the pavement to be taken up, the known purpose and size of the opening to be made and the time when the opening is desired or necessary. Upon filing the application, the applicant shall give cash or a bond in an amount sufficient to cover all damages to the city and the public by reason of the opening or improvement so proposed. The amount and surety thereof shall be approved by the Mayor, conditioned upon the applicant's properly replacing the pavement, after proper tamping of the filled dirt, in as good a condition as it was before the excavation, all of the work to be completed within a designated time at the expense of the applicant and to be performed under the supervision of the Superintendent of Streets and Sewers. The bond shall be further conditioned upon the applicant's keeping proper lights over, above and about the excavation during the work and preserving and keeping the city free and harmless of any costs, expenses, damages or claims arising or growing out of the rights and privileges so granted. Thereupon the Mayor shall issue a permit for the opening of the street, alley, avenue or public grounds so specified in the application.
