(a) Except as provided by division (b) or (c) of this section, any person violating this chapter is guilty of a first degree misdemeanor.
(b) Any person who violates § 838.04(a)(1) shall be guilty of a third degree misdemeanor for a first offense, and a first degree misdemeanor for a second offense.
(c) A person who violates § 838.04(c) above shall be guilty of a third degree misdemeanor for a first offense and a first degree misdemeanor for a second offense.
