§ 440.12 USE OF ALLEYS IN WET WEATHER.
   (a)   No person operating a vehicle that exceeds three tons (6,000 pounds) in gross weight shall use, drive upon, traverse or in any way occupy any public alley in the city with the vehicle when the alley has been posted according to division (b) of this section.
   (b)   Whenever the Superintendent of Streets and Sewers deems it necessary, due to excess water conditions, to close the public alleys within the city to excessively heavy vehicles, he or she shall cause to be posted at the entrance way of each alley a sign no smaller than 160 square inches, which sign shall state that the alley is closed to all vehicles weighing in excess of three tons (6,000 pounds) gross weight and the sign shall cite this section.
   (c)   When the Superintendent of Streets and Sewers deems it necessary to post the alleys, pursuant to this section, he or she shall cause written notice to be sent by certified mail to each common carrier or refuse hauler licensed to do business in the city, setting forth that the alleys are closed to all vehicular traffic exceeding the gross weight as provided above.
