(a) Prior to the enactment of a resolution of necessity required by Charter § 78, the Council shall make a determination pursuant to Charter § 89 as to the city's part of the cost and expense of the improvement for which special assessments are levied as the Council deems just. In making this determination, the Council may consider a number of factors, including but not limited to project design in excess of minimum requirements, unusual topography, the costs of individual septic systems and/or wells, the potential for development of the lands to be benefitted by the public improvement, the revenue sources to pay the city's share, and census data regarding household income.
(b) Council recognizes that each project involving special assessments is unique. Therefore, no determination made in accordance with division (a) above shall constitute a precedent.
