(a) No person shall remove or excavate any soil, sand, gravel or other deposit from land so as to create a pit, gully, ditch, depression or other change to the topography of lands in the Village, except in the following cases:
(1) Where excavation or removal is necessary for the erection, construction or alteration of a building at the location where such removal or excavation is made;
(2) Where removal or excavation is necessary for the installation of a driveway, sidewalk or other improvement in connection with the erection, construction or alteration of a building or structure or in connection with proper use of the land, or in the construction of a swimming pool; and
(3) Where removal or excavation is necessary for the construction or alteration of a ditch or grade which is provided for by ordinance of the Village.
(b) Whoever violates this section is guilty of a misdemeanor of the first degree.
