4-102: KEEPING OF ANIMALS IN GENERAL:
   A.   No owner shall permit any animal owned, harbored, or kept by him to be at large; and it is unlawful for any animal to be at large at any time within the town.
   B.   It is unlawful for any person to open any enclosure in which any animal is confined as required by ordinance so as to turn such animal at large, or in any manner to turn such animal at large.
   C.   It is unlawful for any person to stake, confine, or pasture any animal on any public school ground or other public property, federal, state, town or other, on any railroad right of way, or on any property without the consent of the person owning or controlling such property.    D.   Requiring all dogs kept within the town limits of the town of Shattuck to be kept in a secure pen that is so constructed that any dog or animal kept therein may not escape by jumping over, digging under or breaching or breaking through any part of the fence or enclosure.
   E.   Defining a "leash" as a chain or strap of sufficient strength to maintain control of a dog or animal by the owner or some other person with the owner's permission while in and under control of such person. It does not mean the staking out of a dog or animal on a chain or strap secured to a post, latigo or other secure base.
   F.   The owners of any dog or animal shall be personally responsible for any damage caused by such animal while not kept in a secure enclosure or securely restrained while being accompanied by any person. (Ord. 328, 4-12-1999)
   G.   Any stray dog shall be taken into custody and kept in the animal pound for a period of three (3) days within which time the owner may redeem by having the dog vaccinated and tagged in compliance with this chapter, if not then in compliance.
An administrative fine, which is not to be confused with the misdemeanor fine prescribed by section 4-121, "Penalty", of this chapter, shall be assessed in the amount of twenty dollars ($20.00) in addition to the costs of boarding and maintaining the animal which shall be five dollars ($5.00) per day which may be amended from time to time hereafter by resolution of the board to provide for any greater amount that may be required to reimburse the town of Shattuck for the cost of shelter, food, care and salary of persons performing such care. The amount of the administrative fine shall be doubled for each subsequent violation hereof within any three (3) year period. (Ord. 426, 7-13-2015, eff. 7-13-2015)
   H.   Any vicious dog shall be put to sleep by order of the municipal judge. (Ord. 328, 4-12-1999)
