§ 92.22  STORAGE OF GASOLINE OR OTHER COMBUSTIBLES.
   (A)   (1)   No person, firm or corporation shall erect or cause to be erected or maintained within the town, above the level of the ground, any tank, container or reservoir for the use in the storage of gasoline.
      (2)   Each day the tank, container or reservoir is allowed to remain shall constitute a separate offense.
   (B)   (1)   It shall be unlawful for any person to construct or erect any storage tank for gasoline, oil or other combustible or inflammable materials, containing or capable of containing more than 100 gallons, unless the top of the tank or container is buried at least two feet below the surface of the ground at that point and a permit for the construction or erection is first obtained upon application from the Town Clerk.
      (2)   The Town Clerk shall not issue a permit unless directed by the Board of Commissioners.

   (C)   (1)   It shall be unlawful for any person to install a propane or other liquified petroleum gas (LP gas) container other than in accordance with NFPA 58 (current edition) as adopted in the rules and regulations of the North Carolina Department of Agriculture (02 NCAC 38.0101 et seq., G.S. §§ 119-54 et seq.).
      (2)   Maintenance of the containers shall be in accordance with the above.
