§ 51.082  SURCHARGE FOR NON-COMPLYING DISCHARGE.
   (A)   The Town Manager may, if he or she first determines that the discharge will not be detrimental to the operation of the sanitary sewer system, issue discharge permits for the discharge of industrial waste not meeting all the minimum standards set forth in § 51.081.
   (B)   However, a monthly surcharge shall be levied on the discharge of noncomplying wastes discharged by the permittee.  The monthly surcharge shall be based on the excess pounds of BOD, COD or suspended solids, whichever is greater, contained in the permittee’s sewage flow when the excess is calculated using actual water flow as hereinbefore specified and the difference between actual BOD, COD or suspended solids concentration and the permissible limits set forth in § 51.081.  This surcharge shall be invoked as herein provided in addition to the existing sewer service charge.  The sewer surcharge shall be established by the Board of Commissioners and shall reflect the total cost of treating the excess pounds of industrial waste, including necessary costs of administration of this chapter.
