339.02 LOAD LIMITS ON LOCAL STREETS; LOCAL PERMIT AND CONDITIONS.
   (a)    No person shall drive or operate, or cause to be driven or operated, any vehicle used for the transportation of goods or property upon the streets, bridges and culverts within this Municipality except on designated and marked State and Federal routes, or roadways in commercially developed areas as determined by the Safety Service Director or his designee, and not otherwise marked with appropriate signage indicating “No Trucks” or “No Thru Trucks”.
   Drivers of such vehicles may deliver or pick up goods or property at places not located on such designated routes, may provide services, or visit commercial establishments for the purpose of eating, refueling or conducting other necessary business, provided such commercial establishment provides adequate off-street parking to accommodate such vehicles, and provided such vehicles are only operated in a reasonable way between the designated route and the place of delivery, pick up, service, or such commercial establishment, or as otherwise directed by a police officer.
   (b)    Local Permit and Conditions. Upon application for a good cause, the Safety Service Director may issue a local permit authorizing an applicant to move an oversize or overweight vehicle or combination of vehicles upon local streets.
   No permittee shall be required to obtain a special permit from the Ohio Director of Highways for the movement of the vehicle or combination of vehicles on streets or highways under local jurisdiction; however, the approval of the Ohio Director of Highways shall be required for movement upon State routes as provided in Section 339.01.
   The Safety Service Director may grant a permit for a single or round trip, or for such period of time, not to exceed one year, as the Director in his discretion deems advisable, or for the duration of any construction project. The Director may limit or prescribe terms or conditions of operation for such vehicle or combination of vehicles by designating the route, hours, speed or other restrictions as may be necessary for the preservation of the public peace, property, health and safety. The Director may require the posting of bond or other security necessary to compensate for any damage to a roadway or road structure.
   Violation of any of the limitations, terms or conditions of the permit granted by the Safety Service Director should be cause for immediate revocation or suspension of such permit, and denial of request for any future permit. Such violation shall also subject the violator to the penalty prescribed by Section 303.99.
   (c)    Reading Road Bridge. The load limits for the bridge located on Reading Road immediately south of Sharon Road are hereby established as the total gross vehicle weight as determined by the Ohio Department of Transportation. Violation of this requirement shall constitute a minor misdemeanor.
   (d)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
