905.01 REPAIR OR REPLACEMENT OF RESIDENT MAILBOXES DAMAGED BY CITY SNOW PLOW OPERATIONS.
   (a)   If a mailbox is damaged by City snowplowing, residents should, as soon as the damage occurs, contact the Public Works Department to request a repair evaluation. In all cases, claims shall be filed within thirty (30) days of the alleged damage.
   (b)   Upon evaluation, attempts will be made to temporarily repair the mailbox so mail can be received. If minor damage has occurred, a permanent repair may occur at that time, with a letter being left stating that a repair has been completed or if the mailbox and/or mailbox post needs to be completely replaced. Mailbox repairs will occur as soon as reasonably possible.
   (c)   If replacement is needed, residents generally have two options: Option A - the resident may replace the mailbox, submitting the letter left regarding the damage, along with a name, address, and telephone number with a paid receipt to the Public Works Department for reimbursement up to eighty dollars ($80.00). Mailboxes must be installed to United States Postal Service specifications (e.g., installed at a height of forty-one to forty-five (41-45) inches from the road surface to the bottom of the mailbox or point of mail entry, along with being set-back six to eight (6-8) inches from the front face of curb or road edge to the mailbox door). An inspection will occur before reimbursement. Option B - the resident may request that the city install a standard metal mailbox and/or wood post at no cost to the resident. Installation will be per United States Postal Service requirements.
   (d)   In special circumstances, the above approach may not be sufficient to address a particular issue, such as when residents have chosen to install a decorative or expensive mailbox that has been damaged. Although decorative or expensive mailboxes are currently permitted within the City, they are not a requirement for mail delivery. When a resident would like the City to consider an alternate approach under these circumstances, contact should be made to the Public Works Director, who will discuss the particulars with the resident. The City's policy is to reimburse the resident for expenses upon confirmation that United States Postal Service requirements regarding mailbox placement have been met. The City may choose to reduce costs of the replacement with City installation by the Public Works Department. In this case, United States Postal Service regulations must also be complied with. Special circumstances will only be considered once per property owner with any subsequent mailbox damage reverting back to subsections (b) and (c) hereof for resolution. For subsequent issues, subsection (d) hereof will not be considered because the property owner is on notice of this policy. (Ord. 2023-19. Passed 3-28-23.)
