1314.03 COMPLIANCE AND EXCEPTIONS.
   (a)    There shall be required an informal preliminary approval of all land use plans by the approving agent before detailed water management and sediment control and site plans are submitted to the approving agent for final approval by the Planning Commission. No person shall cause or allow earth disturbing activities on a development area, except in compliance with the standards and criteria as set forth in this chapter pertaining to storm water drainage and detention/retention, soil erosion and sediment control, hillside and cut/fill requirements and flood plain management, as specified in Attachments A, B, C and D which are incorporated by reference into this chapter, unless otherwise excluded by this chapter.
   (b)    The following shall be exempted from the requirements of this chapter:
      (1)    Cemetery operations;
      (2)    A small lot excavation or fill which is:
         A .    Less than four feet deep;
         B.    Less than one hundred cubic yards;
         C.    Does not impair existing surface drainage, constitute a potential erosion hazard or cause sedimentation to adjacent land or watercourse; and
         D.    Has no final slopes greater than 3:1 or is a fill on the surface with slope less than 5:1;
      (3)    Accepted agricultural practices;
(4)    Grading as a maintenance or landscaping measure on existing developed residential lots;
(5)    Temporary excavation, such as trenches, constructed for utility purposes;
(6)    Test boring and other exploratory excavation;
(7)    Single lot development in an approved residential subdivision; and
(8)    Any other land use that is exempted, but only to the extent that it is exempted by the approving agent. (Ord. 91-66. Passed 7-6-91.)
