557.05 APPEALS TO THE AIR POLLUTION HEARING BOARD.
   Any person aggrieved by a decision, ruling or order of the Air Pollution Control Officer may take an appeal to the Air Pollution Hearing Board established by this chapter. Such appeal shall be taken within ten days after the decision, ruling or order complained of by filing with the Air Pollution Control Officer a notice of appeal directed to the Air Pollution Hearing Board, specifying the grounds thereof and the relief prayed for. The Air Pollution Control Officer shall forthwith transmit to the Board all papers constituting the record upon which the decision, ruling or order appealed from is taken. The Board shall fix a reasonable time for the hearing of the appeal and give due notice thereof by mail to the parties in interest and decide the same within a reasonable time. The filing of an appeal shall operate as a stay of the decision, ruling or order complained of, until final action is taken by the Board on the appeal. Parties appealing to the Board may appear at any hearing in person, or by agent or by attorney. A fee of twenty-five dollars ($25.00) shall be paid to the Air Pollution Hearing Board at the time the appeal is filed. The Board, upon hearing such appeal, may either affirm, modify or set aside any such decision, ruling or order. No fee shall be required for matters brought before the Air Pollution Hearing Board by the Air Pollution Control Officer.
