(a) "Street excavation" under this appendix shall include all excavation of or tunneling under any street owned by the City of Sharon. The fee for street excavation shall be as follows:
(1) A permit application and fee of one hundred dollars ($100.00) shall be charged for each proposed street excavation. In the case of work having been completed or substantially commenced without a permit having been obtained, the fee shall be doubled to $200, which, at the City’s option, may substitute for a summary offense citation or be in addition to a citation. A degradation fee may also be charged for each street excavation as provided in Table 2
.
(3) Performance guarantees shall be required for all street excavations in accordance with the provisions of Section 1020.05
(b).
(b) “Right-of-way excavation” under this appendix shall include all excavation of or work in any right-of-way of the City of Sharon other than a street, including but not limited to sidewalks and driveways. The fee for right-of-way excavation shall be as follows:
(1) A permit application and fee of one hundred dollars ($100.00) shall be charged for each proposed right-of-way excavation. In the case of work having been completed or substantially commenced without a permit having been obtained, the fee shall be doubled to $200, which, at the City’s option, may substitute for a summary offense citation or be in addition to a citation.
(2) An inspection fee shall be calculated as shown in Table 1
for each proposed right-of-way excavation.
(c) If a single owner proposes to do work that constitutes both a street excavation and a right-of-way excavation, the owner shall be liable for fees under subsections (a) and (b) where applicable.
(d) All fees established above may be changed by resolution of City Council. If any part of this appendix is held illegal or unconstitutional, it is intended that the remaining parts continue in force.
