Any person furnishing materials or performing labor on any contract for which such bond is furnished may enter suit on the bond, either with or without special leave of the City, for the collection of any unpaid balance of his claim, provided that such suit is commenced within one year from the completion of the contract and the acceptance of the work by Council.
