3-1-5: CLASSIFICATION OF LICENSES; FEES:
Liquor licenses issued by the village shall be and they hereby are divided into three (3) classes, as follows. All licenses issued hereunder shall be designated by the classification letter herein provided:
   A.   Class A: Class A licenses shall authorize the retail sale on the premises specified in such license of alcoholic liquor for consumption on the premises, as well as other retail sales of such liquor. The annual fee for such license shall be six hundred dollars ($600.00).
      1.   The holder of a class A license may apply for an additional permit for an outside retail sales and seating area for the consumption of alcoholic liquor on the premises. The annual fee for such permit shall be one hundred dollars ($100.00).
      2.   The outside retail sales and seating area must be contiguous to the building and located on the premises where the indoor sale of alcoholic liquor is otherwise permitted.
      3.   The outside retail sales and seating area shall be constructed in a manner that permits ingress and egress to such area only from the indoor serving area.
      4.   The outside retail sales and seating area shall be enclosed by permanent fencing not less than six feet (6') in height. In order to enforce the provisions of this subsection, the local liquor control commissioner shall have the right to require the filing with him of plans and drawings detailing the location, composition, design and construction of the fence.
      5.   All restrictions on hours of operation in subsections 3-1-8A, B and C of this chapter shall apply to the outside retail sales and seating area.
   B.   Class B: Class B licenses shall authorize the retail sale of beer, wine and liquor for consumption off the premises. The annual fee for such license shall be four hundred fifty dollars ($450.00).
   C.   Class C:
      1.   Description: The village president, as local liquor control commissioner, shall have the power to issue a temporary special events license to any current class A liquor license or not for profit organizations for the sale of beer and wine between the hours of twelve o'clock (12:00) noon and eleven thirty o'clock (11:30) P.M. for a specific event, not to exceed three (3) consecutive days, at a location set forth on the face of the license. The temporary special events license will allow the sale of beer and wine for consumption at the location set forth in the license and shall not allow any package goods sales or removal of alcoholic liquor from the location set forth in the license.
      2.   Application For License; Insurance Required: The application for class C license shall be made in writing to the local liquor control commissioner and shall specify the location, day(s), time(s) and the nature of the event where the sale of alcoholic beverages will take place. The applicant must attach proof of dramshop insurance.
      3.   License Fee: The fee for such temporary special events license shall be one hundred dollars ($100.00) per event, payable in advance.
      4.   Compliance With State Law: There shall be compliance with all state laws in connection with use of the temporary special events license.
      5.   Events In Public Areas: In the event the location set forth in the license should be a public street or public area, any ordinances concerning consumption of alcohol in public places shall not apply to the location set forth in the license, and the licensee and patrons of the licensee shall not be deemed to have violated such ordinances.
      6.   Discretionary License; Conditions: The issuance and terms of a temporary special events license is solely within the discretion of the local liquor control commissioner. The local liquor control commissioner may impose any such additional conditions to the temporary special events license as he determines in his sole discretion are necessary to protect the best interests of the village and its citizens.
