§ 52.005  LIMITATIONS ON RADIOACTIVE WASTES.
   No person shall discharge or cause to be discharged any radioactive waste into a community sewer except:
   (A)   When the person is authorized to use radioactive materials by the State Department of Health or other government agency empowered to regulate the use of radioactive materials;
   (B)   When the waste is discharged in strict conformity with then current North Carolina Radiation Control and Atomic Energy Commission (AEC) regulations and recommendations for safe disposal;
   (C)   When the person is in compliance with all lawful rules and regulations of all other applicable regulatory agencies having jurisdiction; and
   (D)   When several users are discharging radioactive wastes or materials to the public sewer, they shall, upon notification, cooperate in limiting the release of the material and shall file with the town a statement of their agreed pro-rated discharges.  If this is not done within a reasonable time after notifications, sewer use may be discontinued by the town.
