Unless a commercial establishment in the town regularly discards not more trash or rubbish than would fit in a 90-gallon roll-out cart and five bags or containers, the bags or containers defined in the town’s solid waste collection contract with its solid waste collection contractor, the commercial establishment shall contract with the town’s solid waste collection contractor for dumpster service unless the commercial establishment hauls its own trash or rubbish away to a designated landfill. Inasmuch as the town has given an exclusive right to pick up waste to the town’s solid waste contractor, commercial establishments may not contract with another party to haul away their trash or rubbish.
