137.02 ESTABLISHMENT; COMPOSITION, TERM AND VACANCY.
There is hereby established the City of Shaker Heights Landmark Commission, which shall consist of seven (7) members, six (6) of whom shall be residents of the City not holding other public office or employment with the City or the Shaker Heights Board of Education, who have demonstrated an interest, experience or knowledge in history, architecture or related disciplines, appointed by the Mayor and confirmed by Council. Commencing January 1, 1993, two (2) members shall be appointed to a term of one (1) year, two (2) members shall be appointed to a term of two (2) years, and two (2) members shall be appointed to a term of three (3) years. Thereafter, each member appointed shall have a term of three (3) years. The terms of the current members of the Commission referred to herein shall expire on December 31, 1992. As to not more than one (1) of the six (6) members referred to herein, Council may waive the requirements that such member be a resident of the City and/or hold no other public office with the City or the School Board. Of the six (6) members referred to herein, two (2) members shall be preservation-related professionals; provided, however, that such professionals are, in fact, available in the community, as determined by the Mayor. The seventh member of the Commission shall be a member of Council appointed by the Mayor for a term of two (2) years. Vacancies shall be filled for the remainder of the unexpired terms in the same manner as regular appointments and confirmations. A vacancy shall be filled within sixty (60) days from the date the vacancy occurs, unless a greater period of time is reasonably necessary, as determined by the Mayor. In the case of temporary absence or disability of any member, a member may be appointed and confirmed in the manner provided above to serve during such temporary absence or disability. Such temporary member shall possess all of the qualifications of a regular member, and shall have the same powers and perform the same duties as a regular member during the term of his appointment. The Mayor and the Planning Director shall serve as ex officio members of this Landmark Commission.
