122.04 WARNING AND ADMINISTRATIVE FEE.
(a) The Chief of Police or Fire or their designees shall issue warnings and order the assessment of administrative fees against the user of an alarm system and/or provider of such system, depending on which Department responds to a false alarm. The administrative fee is a partial reimbursement to the City for the cost of receiving and responding to a false alarm. The number of false alarms shall be counted within any ongoing period of twenty-four (24) months. Police and Fire false alarms shall be counted separately for the purpose of counting the number of false alarms. The Chiefs of Police and Fire shall issue the guidelines that they intend to follow in the administration of this section.

(b) The Chief of Police or Fire may waive all or part of the above fees for a newly installed alarm system during the thirty (30) days immediately following the completion of the installation to a maximum of three (3) false alarms.
(c) The Chief of Police or Fire may order that the user or provider prove that the cause of the false alarm notification has been remedied.
(d) If the user fails to pay the administrative fee within thirty days thereof, the Chief of Police or Fire shall report the delinquency to the Director of Finance, who shall report the same to Council, which may thereupon assess the cost, together with the expense of assessing and collecting the same, upon the property upon which the alarm system is located, and cause the assessment to be certified to the County Auditor for collection.
(e) The Chief of Police may order the revocation of a permit or refuse to issue a permit, or order the disconnection of an existing alarm, or refuse to connect a previously disconnected alarm, until payment is made of all existing false alarm charges incurred by the user or provider that may be owed to either the Police or Fire Department.
