1317.04 ISSUANCE AND DISPLAY OF PERMIT; REVOCATION.
(a) If, upon inspection of the commercial structure, it is determined by the Commissioner of Building that the structure is in compliance with the Codified Ordinances of the City, the Commissioner shall issue a commercial occupancy permit.
(b) If, upon inspection it is determined that the commercial structure is in substantial compliance with the Codified Ordinances of the City, the Commissioner of Building may, at his discretion, issue a qualified commercial occupancy permit subject to the correction of all violations within a specified period of time. Such qualified permit shall be issued only upon an agreement signed by the owner of the commercial structure or his agent, or other person responsible for maintenance or repair of the structure, specifying a time period for completion of such corrections, not to exceed ninety (90) days, which period has been approved by the Commissioner of Building. Failure to correct the violation within the agreed time period shall void such qualified permit. No qualified permit shall be issued where corrections which were required as a result of a prior change of occupancy have not yet been completed.
(c) A commercial occupancy permit shall become void under any of the following circumstances:
(1) A change in the use or occupancy of a commercial structure or part thereof covered by a commercial occupancy permit.
(2) For refusal or failure of the owner, agent, person in charge or control, or occupant of a commercial structure to comply with the provisions of a written order of the Commissioner of Building issued pursuant to the Codified Ordinances of the City, or for failure to comply with a written agreement made pursuant to the issuance of a qualified commercial occupancy permit.
(3) If any false statement has been made by any party on an application for a permit issued.
(4) For noncompliance of a commercial structure or its use with the provisions of this chapter.
