1309.11 DWELLING STRUCTURES.
(a) In addition to submission to the Architectural Board of Review, the plans and specifications for the construction of a dwelling structure shall be reviewed for approval by the City Planning Commission. The Planning Director or his or her designee, shall notify the applicant in writing of the time and place of the meeting of the Planning Commission wherein such plans and specifications will be reviewed. No building permit shall be issued by the Commissioner of Building until such plans and specifications have been approved by the Planning Commission.
(b) Approval by the City Planning Commission as provided herein shall only be made upon a finding by the Commission that:
(1) The design, materials, location and configuration of the proposed structure will be reasonably compatible in size, quality and appearance with existing structures in the immediate neighborhood.
(2) The design and materials, appearance and quality of construction of the proposed structure will not adversely affect the market value of existing structures in the immediate neighborhood.
(3) There exists sufficient likelihood that the applicant has sufficient financial resources to enable complete construction in accordance with the Building Code and the plans and specifications so submitted.
(c) In reviewing the foregoing factors, the Planning Commission may make such further findings and impose such further conditions as it deems necessary to comply with the Building Code and Zoning Code, and to protect the health, safety and welfare of the residents of the neighborhood where the structure is to be located.
