1139.08 LOADS DROPPING OR LEAKING; REMOVAL REQUIRED; TRACKING MUD.
   (a)   No person shall operate any vehicle or cause or permit any vehicle to be operated upon any public street within this City, from which vehicle mud, dirt or any other substance or material falls, sifts, leaks, or in any other manner is discharged or deposited upon the surfacing of the street, except that sand, salt or other substance may be dropped by the City, Cuyahoga County or State of Ohio, or their employees, for the purpose of securing traction or in connection with the cleaning or maintenance of any street. No owner of property, person in possession or contractor performing work on any property, from which trucks or other vehicles enter any public street within this City, shall cause or permit any such truck or other vehicle to enter a public street in such a manner or condition as to deposit mud, dirt or other material from the wheels or load of such vehicle upon any public street.

   (b)   Except for a farm vehicle used to transport agricultural produce or agricultural production materials or a rubbish vehicle in the process of acquiring its load, no vehicle loaded with garbage, swill, cans, bottles, waste paper, ashes, refuse, trash, rubbish, waste, wire, paper, cartons, boxes, glass, solid waste or any other material of an unsanitary nature that is susceptible to blowing or bouncing from a moving vehicle shall be driven or moved on any street, highway or other public place unless the load is covered with a sufficient cover to prevent the load or any part of the load from spilling onto the street, highway or other public place.

   (c)   It shall be the duty of the driver of a vehicle who unlawfully drops or deposits mud, stones, gravel or other similar material or permits the load or any portion thereof to be dropped or deposited upon any street, highway or other public place to immediately remove the same or cause it to be removed.
