1137.99 PENALTY.
   (EDITOR'S NOTE: See Section 1103.99 for penalties applicable to any misdemeanor classification.)
   (a)   Child Restraint Systems.
      (1)   Whoever is a resident of this State and violates Section 1137.26 is guilty of a minor misdemeanor on a first offense; on a second or subsequent offense, that person is guilty of a misdemeanor of the fourth degree.
      (2)   Whoever is not a resident of this State, violates Section 1137.26, and fails to prove by a preponderance of the evidence that his use or nonuse of a child restraint system was in accordance with the law of the state of which he is a resident is guilty of a minor misdemeanor on a first offense; on a second or subsequent offense, that person is guilty of a misdemeanor of the fourth degree.

   (b)   Seat Belt Requirements.
      (1)   Whoever violates Section 1137.27(b)(1) shall be fined thirty dollars ($30.00).
      (2)   Whoever violates Section 1137.27(b)(3) shall be fined twenty dollars ($20.00).
