905.05 EMISSION OF AIR CONTAMINANTS; AIR ALERT.
   (a)   No person shall permit the discharge into the atmosphere from any single source of emission whatsoever of any air contaminant of a shade or density equal to or darker than that designated as number one (1) on the Ringelmann Chart furnished by the Bureau of Mines, U.S. Department of Interior, or twenty percent (20%) opacity, except a person may cause the discharge into the atmosphere from any single source of emission for a period or periods aggregating not more than three (3) minutes in any sixty (60) minute period, air contaminants of a shade or density not darker than number three (3) on the Ringelmann Chart or sixty percent (60%) opacity. It shall not be deemed a violation of this regulation where the presence of uncombined water is the only reason for failure of an emission to meet the requirements of this section.
   (b)   At any time the Air Pollution Index for the City of Cleveland is two hundred (200) or greater an air alert shall be deemed to exist in the City of Shaker Heights. No person shall knowingly operate or permit the operation of any incinerator within the City during the period of any air alert. (Ord. 10-11. Enacted 2-22-10.)
