901.09 FIRE DAMAGED STRUCTURES; REMOVAL OR REPAIR SECURING FUND.
   (a)   The City hereby authorizes the procedure described in Ohio R.C. 3929.86(C) and (D) to be implemented whereby no insurance company doing business in the State shall pay a claim of a named insured for fire damage to a structure located within the City unless the applicable provisions of Ohio R.C. 3929.86 are fully complied with. The Fire Chief is hereby designated as the officer authorized to carry out the duties of Ohio R.C. 3929.86. The Fire Chief shall file a certified copy of this section with the State Superintendent of Insurance.
   (b)   Any building, grounds or structure that has been damaged by fire, shall be secured from tampering or trespass and maintained in a nuisance free condition by the owner or his agent, in a manner acceptable to the Fire Chief
   (c)   All fire debris shall be removed from the outside of the property within fifteen days after being damaged by fire or explosion.
   (d)   All structures damaged by fire or explosion shall have repairs begun or the damaged property shall be demolished within ninety days after being damaged by fire or explosion. Structures involved in suspicious or arson fires which are deemed as evidence by the Fire Chief shall not be repaired or demolished until the Fire Chief approves such activity in writing.
   (e)   Any grounds, property or structure which has been fire damaged or damaged due to explosion, or where debris from a fire or explosion is present, may be declared to be a public nuisance by the Fire Chief or the Chief's agent if the structure has not been repaired or demolished, or if the debris has not been removed, in a reasonable period of time as determined by the Fire Chief or the Chief's agent, or if the conditions represent an immediate danger to the public. The Fire Chief or the Chief's designee may issue an order to repair, demolish or remove debris pursuant to Chapter 107 of the Codified Ordinances, including an emergency order. The procedure and the right of appeal shall be as set forth in Chapter 107. The City may abate the nuisance and collect its costs as set forth in Chapter 107.
