901.06 MODIFICATIONS.
   The Fire Chief shall have the power to modify any of the provisions of this Fire Prevention Code upon application in writing by the owner, lessee or the duly authorized agent of either the owner or lessee when there are practical difficulties in the way of carrying out the strict letter of this Fire Prevention Code, provided that the spirit of such Code shall be observed, public safety secured and substantial justice done.
   (a)   A request for a modification must be set forth in writing. The request must demonstrate the following:
      (1)    The practical difficulties claimed.
      (2)   That the modification will not threaten the public health, safety or welfare; and
      (3)   That the party will provide measures to protect the public health, safety and welfare that are substantially equivalent to the measures otherwise required under the Fire Prevention Code.
   (b)   The Chief may request additional information and documentation, which shall be provided promptly by the requesting person. The Chief shall approve or disapprove the request in writing sent to the person making the request. Any modification approved by the Chief shall specify the term of the modification. Application must be made and approved by the Chief for any renewal.
