709.13 MINORS' CURFEW.
(a) No child under the age of fifteen (15) years shall be upon the streets or sidewalks or any public property or any place open to the public within the City between the hours of 11:00 p.m. and 5:00 a.m. of the following morning; nor shall any child of or over the age of fifteen (15) but under the age of eighteen (18) years be upon the streets or sidewalks or any public property within the City between the hours of 1:00 a.m. and 5:00 a.m. However, the provisions of this section do not apply to a minor accompanied by his parent, guardian or other adult person having the care and custody of the minor, or where the minor is upon an emergency errand or upon a business trip directed or ordered by his parent, guardian or other adult person having the care and custody of the minor.
(b) No parent or guardian of any child under the age of fifteen (15) years shall allow such child to be on the streets or sidewalks or any public property or any place open to the public within the City between the hours of 11:00 p.m. and 5:00 a.m. of the following morning, nor shall any parent or guardian of any child of or over the age of fifteen (15) but under the age of eighteen (18) years allow such child to be upon the streets or sidewalks between the hours of 1:00 a.m. and 5:00 a.m. However, the provisions of this section do not apply to a minor accompanied by his parent or guardian or to any other adult person having the care and custody of the minor, or where the minor is upon an emergency errand or upon a business trip directed or ordered by his parent or guardian or by any other adult person having the care and custody of the minor.
(c) Any school, church, lodge or other organization, or parent or guardian who desires to hold any entertainment for minors under the age of eighteen (18) years, and which entertainment shall require such minors to be out at a later hour than that called for in this section shall register in advance in person with the Chief of Police or an officer designated by him to have the minors stay out to this later hour. The application shall state the approximate time the entertainment will end, and the minors who attend this function shall be required to be off the public streets one-half hour after the function is ended.
(d) Any child found in violation of this section shall be taken to the Youth Bureau of the Police Department and the parent, guardian or person in loco parentis shall be notified to come to such building and take personal charge of the child. The child shall be released only to such parent, guardian or person in loco parentis, or to the juvenile authorities.

(e) Any parent, guardian or person in loco parentis who violates this section is guilty of a misdemeanor of the first degree.
