§ 73.66 DETERMINING PARKING VIOLATIONS; PROCEDURES.
   The procedures for regulating the parking of vehicles and determining overtime parking may include the following.
   (A)   The city Police Department is authorized to determine the method or methods by which the parking attendant is allowed to determine parking violations.

   (B)   In the event a member of, or civil employee of, the city Police Department determines that a vehicle has been parked overtime, it shall then be the duty of that member or civil employee, as aforementioned, to ticket that vehicle, which ticket shall include, but not necessarily be limited to, the following:
      (1)   A designation of, or location of, the alleged overtime parking;
      (2)   The state license number of the vehicle;
      (3)   The date and hour of the alleged offense; and
      (4)   The specific section of this code the owner or operator is charged with violating, and the specific form of the ticket to be as prescribed by the Chief of Police, but to be different than the state Uniform Traffic Ticket.

   (C)   In the event that three citations are issued to the registered owner of a motor vehicle and remain unpaid for a period of 30 days, the Clerk-Treasurer of the city shall forward a written notice to the registered owner of the vehicle or vehicles that:
      (1)   If the assessed fines are not paid within 14 days from the date of the Clerk-Treasurer’s written notice, the citations shall be forwarded to the City Attorney for prosecution; and
      (2)   In the event that the registered owner fails to pay those citations within 14 days of notice, the City Attorney may initiate legal proceedings in the appropriate court for collection of the unpaid fine or fines. The violator shall also be liable for court costs as prescribed by the County Clerk.
   (D)   (1)   The provisions of Ch. 75, Sch. II, Table C, regarding two-hour parking, only apply to vehicles parked or standing on the streets of the city in the specifically designated areas during the periods of time set forth as follows: on Monday through Friday of each week, between the hours of 9:00 a.m. and 5:00 p.m.

      (2)   With regard to the provisions of Ch. 75, Sch. II, Table C, regarding two-hour parking, all parking shall be designated by markings.
   (E)   The parking attendant is authorized to issue parking citations for any parking violation, including but not limited to violations of any handicap, fire hydrant, alleyway, and time limit regulations.
   (F)   In the event that three citations are issued to the registered owner of a motor vehicle and remain unpaid for a period of 30 days, the Clerk-Treasurer of the city shall forward a written notice of the unpaid citations to the Bureau of Motor Vehicles to be attached to the owner’s driver’s license.
    (G)   The Clerk-Treasurer of the city is authorized to void tickets for persons who have exceeded the two-hour limitation while receiving services from downtown professional businesses. The ticket must be signed by the professional service providing the service. Matters of disability will be given serious consideration.
