(A) The procedure for appealing a notice of violation or a bill issued under this subchapter shall be by written notice to the Board of Public Works and Safety, received prior to the time specified to respond or act in the notice of violation or the bill issued, stating the reason for the appeal and requesting a hearing by the Board of Public Works and Safety.
(B) A hearing shall be set by the Board of Public Works and Safety on a business day no earlier than ten days after the request for hearing is received.
(C) Each person may appear at the hearing in person or by counsel and is entitled to present evidence, cross-examine opposing witnesses, and present arguments.
(D) The decision of the Board of Public Works and Safety after hearing is subject to review by the Circuit or Superior Court of the county. A person seeking judicial review must file a complaint with the court within ten days of the Board’s decision.
