331.39 REPLACING BARRIER OR LIGHTS OR NOTIFY POLICE.
   (a)   No person who is aware that he has removed or damaged any barrier, light or other warning device, or who has extinguished any light, shall fail to stop and immediately replace such barrier or other warning device, or relight such light if extinguished, or in lieu thereof to immediately notify the Police Department that such barrier, light or other warning device has been damaged, removed or extinguished.

   (b)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
