311.02 PARADES AND ASSEMBLAGES.
   (a)    Permit Required. No person or persons shall parade or hold a procession or attempt to parade or hold a procession in or upon any of the streets, highways, parks or public grounds of the City unless and until such person or persons first obtain the permit hereinafter provided.
(b)    Driving through Parades Prohibited. No driver of a vehicle shall drive between the vehicles or persons comprising a parade or other authorized procession when vehicles or persons are in motion and are conspicuously designated as a parade or a procession.
(c)    Issuance of Permits. Any person or persons desiring to parade or hold a procession in or upon any street, park or public ground of the City for any purpose whatsoever shall, before parading or holding a procession, obtain from the Director of Public Safety a permit therefor, which shall be issued only upon and after the approval of the application therefor by the Chief of Police.
(d)    Prior Application for Permit. Each application for a permit shall be made out in duplicate, each copy thereof to be signed by the applicant and shall be in such form as prescribed, The application shall be filed at least fourteen days prior to the date upon which the parade or procession is to be held.
   (e)    Permit Refusal or Revocation. The Director of Public Safety may refuse to issue the permit if the applicant, group, organization or persons represented by the applicant shall have previously violated the provisions of a similar permit or shall have violated any of the ordinances of the City or laws of the State or of the United States in connection with a previous parade or procession in or upon the streets, parks or public grounds of the City or elsewhere; of if by reason of the nature of the proposed parade or procession or of the character and type of the objects to be promoted or for any other reason the Director of Public Safety shall be of the opinion that the granting of the permit for the proposed parade or procession will result in, provoke or tend to provoke disorderly conduct or create a disturbance, or will result in the violation of the ordinances of the City or laws of the State or of the United States.

   (f)   Penalty. Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
