159.04 MAYOR’S COURT MAGISTRATE.
   (a)   There is hereby established the part-time position of Magistrate of the Mayor's Court. The Magistrate shall perform the duties of a Mayor's Court Magistrate, as defined by the Ohio R.C. 1905.01 and shall be qualified as required by State law. The Magistrate shall also hear the City’s Regional Income Tax delinquent cases.

   (b)   The Mayor shall appoint the Mayor’s Court Magistrate who shall meet the qualifications of Court Magistrate as required by State Law. Such appointment shall be for a period not to exceed one year.

   (c)   The salary of the Magistrate shall be six thousand five hundred dollars ($6,500.00) per annum, payable in equal monthly installments. The Magistrate’s monthly compensation shall at all times be not less than the State minimum amount required to earn one month of Public Employees Retirement System credit and shall be automatically adjusted during his or her terms of office if the State minimum is increased to a level in excess of his or her scheduled compensation for his or her current term.

   (d)   The City's Magistrate is hereby authorized to appoint an individual to preside over Mayor's Court in his absence. This individual shall meet the qualifications of Court Magistrate as required by State law. Compensation for the person presiding over Mayor's Court in the Magistrate's absence shall be two hundred dollars ($200.00) per Mayor's Court.
