1143.70 NOTICE OF VIOLATION.
   (a)   Whenever the Building Commissioner shall find any dwelling structure or premises, or any part thereof, to be in violation of any of the provisions of this Exterior Minimum Maintenance Code, the Commissioner shall give or cause to be given or mailed, via ordinary U.S. mail, to the owner, agent, operator or occupant of such structure or premises a written notice (courtesy notice/non-compliance notice) stating the violation therein. Such notice shall order the owner, agent, operator or occupant within a stated reasonable time (but not less than ten days), to repair, improve or demolish the structure or premises concerned. Such delivery or mailing shall be deemed legal service of notice.
   (b)   A person issued a written notice (non-compliance notice) shall:
      (1)   Pay an administrative fee of ten dollars ($10.00) to the Building Department for the City of Seven Hills within 30 days of the issuance of the courtesy notice (non-compliance notice) as a settlement and compromise of the claim against the accused; and
      (2)   Correct, repair, or rectify the condition resulting in the issuance of the courtesy notice (non-compliance notice) within ten days.
   (c)   If the accused fails to comply with the provisions of subsection (b) herein:
      (1)   The courtesy notice (non-compliance notice) may be converted to a complaint or notice to appear which shall be filed with the Municipal Court and the accused shall be subject to prosecution and the fines and penalties authorized by law which shall include the ten dollar ($10.00) administrative fee; or
      (2)   Additional courtesy notices (non-compliance notices) may be issued.
   (d)   If the owner fails to pay the costs within 30 days after receipt from the City of Seven Hills’ Building Department of a statement of the charges and costs incurred therein, the Building Department may certify such amount to the County Auditor for the purpose of making expenses and placing a lien upon such lands, to be collected as other taxes, and returned to the City with accounting thereof in accordance with Ohio R.C. 715.261.
   (e)   It will be at the discretion of the Building Commissioner if the ten dollar ($10.00) administrative fee shall be waived.
   (f)   The Building Commissioner is authorized to promulgate administrative regulations to implement this section. (Ord. 79-2011. Passed 5-9-11.)
