1125.061 MOVEMENT OF RESIDENTIAL DWELLINGS AND STRUCTURES.
   (a)   Before a moving permit shall be issued for the moving of any residential dwelling or structure to a lot in the City, or through and over streets of the City, the person, firm or corporation who is the owner thereof shall submit a written application and fee in the amount of one hundred dollars ($100.00) to the Building Commissioner for a moving permit. Prior to the issuance thereof, and the posting of the required bonds therefor as provided in subsections (b) and (c) hereof, the Building Commissioner shall inspect the dwelling or structure contemplated to be moved to a lot in this Municipality, and determine the architectural compatibility of the residential dwelling or structure with existing structures in an area of three hundred feet on either side of the lot on which such dwelling or structure is contemplated to be moved and determine that the lot is in conformity with the applicable building and zoning requirements of the City. If the Building Commissioner determines that such lot on which the dwelling or structure is to be moved is not in conformity with the applicable zoning requirements of the City, the person, firm or corporation who is the owner thereof may appeal such decision to the Zoning Board of Appeals.
   (b)   Before any residential dwelling or structure, for which an application for a moving permit has been made, can be moved to or through and over the rights of way of the City, the person, firm or corporation who is the owner thereof shall post a cash or surety bond in the amount of fifteen thousand dollars ($15,000) with the Building Commissioner to guarantee the repair of any damage caused to the City streets or the repair or replacement of other property damaged while moving such residential dwelling or structures.
   (c)   In addition to the requirements of subsections (a) and (b) hereof, the person, firm or corporation who is the owner of the residential dwelling or structure to which the moving permit is applicable shall post a cash or surety completion performance bond in the amount of fifteen thousand dollars ($15,000) with the Building Commissioner, to guarantee the completion of such residential dwelling or structure within ninety days from the date the moving permit therefor is issued.
   (d)   In addition to the requirements of subsections (a), (b) and (c) hereof, the person, firm or corporation who is the owner of the residential dwelling or structure to which the moving permit is applicable shall make arrangements with the Safety Director or his representative to hire, at the cost of the person, firm or corporation, a member of the Auxiliary Police Unit to control and direct traffic during the movement of the dwelling or structure.
   (e)   In the event the residential dwelling or structure, for which a moving permit has been issued, has been moved to the lot but is not suitable and ready for occupancy or the lot not fully restored to grade level within the time prescribed in subsection (c) hereof, the City shall notify such surety and principal to complete the work necessary within thirty days. Upon failure of the surety and/or principal to complete the work within the time period specified, the Law Director shall commence forfeiture proceedings against such surety and/or principal.
   (f)    In the event the residential dwelling or structure has not been moved to the lot in the City and permanently affixed thereto within ninety days from the date the moving permit therefor is issued, the moving permit shall become void and of no effect.
   (g)    No residential dwelling or structure shall be moved or transported through or within the Municipality during the hours of 7:00 a.m. to 9:00 a.m. and 4:00 p.m. to 6:00 p.m. on Monday through Friday.
