733.08 DEFINITIONS.
   Unless the context specifically indicates otherwise, the meaning of terms used in Sections 729.03 and 729.08, Ordinance 89-1970 and this chapter shall be as follows:
   (a)    "Biochemical oxygen demand" (BOD) means the quantity of oxygen used in the biochemical oxidation of organic matter under standard laboratory procedure in five days at 20° C, expressed in milligrams per liter.
   (b)    "Suspended solids" means total suspended matter that either floats on the surface of, or is in suspension in water, wastewater or other liquids, and that is removable by laboratory filtering as prescribed in "Standard Methods" and referred to as nonfilterable residue.
   (c)    "Industrial wastes" means the wastewater from industrial processes, trade or business as distinct from domestic or sanitary wastes.
   (d)    "Sanitary sewer" means a sewer that carries liquid and water-carried wastes from residences, commercial buildings, industrial plants and institutions together with minor quantities or ground, storm and surface waters that are not admitted intentionally.
   (e)    "Combined sewer" means a sewer intended to receive both wastewater and storm or surface water.
   (f)    "User charge" means that amount paid by each premises connected to the wastewater facilities proportionate to the service provided. This charge shall cover all operation, maintenance and replacement cost for the facilities.
   (g)    "Building sewer" means the extension from the building drain to the public sewer or other place of disposal, also called house connection.
   (h)    "Compatible pollutant" means pollutants that the treatment plant was designed to treat which are BOD, SS, phosphorus, and fecal coliform bacteria, plus additional pollutants identified in the NPDES permit if the publicly owned treatment works was designed to treat such pollutants and in fact does remove such pollutants to a substantial degree.
   (i)    "Connection charge" means that amount paid by each new premises connected to the wastewater treatment system to pay for the City's share of facilities required to serve the premises.
   (j)    "Easement" means an acquired legal right for the specific use of land owned by others.
   (k)    "Floatable oil" is oil, fat or grease in a physical state such that it will separate by gravity from wastewater by treatment in an approved pretreatment facility. Wastewater shall be considered free of floatable fat if it is properly pretreated and the wastewater does not interfere with the collection system.
   (l)    "Garbage" means the animal and vegetable waste resulting from the handling, preparation, cooking and serving of foods.
   (m)    "Natural outlet" means any outlet, including storm sewers and combined sewer overflows, into a watercourse, pond, ditch, lake or other body of surface or groundwater.
   (n)    "Non-industrial user" means all users of the wastewater facilities not classified as an industrial user.
   (o)    "NPDES permit" means a National Pollutant Discharge Elimination System permit as issued by the State of Ohio Environmental Protection Agency under authorization issued by the U. S. EPA, Region 5, March 11, 1974.
   (p)    "Operation, maintenance and replacement costs" means those costs, including labor, materials, supplies, equipment, accessories and appurtenances, required to operate the facilities, keep the facilities in operating condition and maintain the capacity and performance during the service life of the sewerage system.
   (q)    "pH" means the logarithm of the reciprocal of hydrogen ion concentration. The concentration is the weight of hydrogen ions, in grams, per liter of solution.
   (r)    "Phosphorus" means the total phosphorus content of a sample including all of the orthophosphates and condences phosphates, both soluble and insoluble, and organic and inorganic species, as referred to in "Standard Methods" as total phosphorus.
   (s)    "Pretreatment" means the treatment of wastewaters from sources before introduction into the treatment works.
   (t)    "Normal domestic sewage" means wastes which are characterized by a per capita discharge of 100 gallons/ day at a loading of 200 mg/l BOD and 250 mg/SS.
   (u)    "Sewage" is the spent water of a community. The preferred term is "wastewater"
   (v)    "Sewer" means a pipe or conduit that carries wastewater or drainage water.
   (w)    "Shall" is mandatory.
   (x)    "Storm drain" (sometimes termed "storm sewer") means a drain or sewer for conveying water, groundwater, subsurface water or unpolluted water from any source.
   (y)    "Unpolluted water" is water of quality equal to or better than the effluent criteria in effect or water that would not cause violation of receiving water quality standards and would not be benefitted by discharge to the sanitary sewers and wastewater treatment facilities provided.
   (z)    "Wastewater" means the spent water of a community. From the standpoint of source, it may be a combination of the liquid and water-carried wastes from residences, commercial buildings, industrial plants and institutions, together with any groundwater, surface water and stormwater that may be present.
   (aa)    "Wastewater treatment works" generally means the structures, equipment and processes required to collect, carry away and treat domestic and industrial wastes and dispose of the effluent.
   (bb)    "Watercourse" means a natural or artificial channel for the passage of water either continuously or intermittently.
   (cc)    "Engineer" means the City Engineer of the City employed by ordinance or a full-time City employee.
   (dd)    "Industrial user" means any nongovernmental user of the treatment works identified in the standard Industrial Classification Manual, 1972, Office of Management and Budget, as amended and supplemented under the following divisions: Division A, Division B. Division D, Division E, Division I. A user in such divisions may be excluded if it is determined that it will introduce primary segregated domestic waste or wastes from sanitary conveniences.
