(a) Any commercial property within the City shall provide an enclosure acceptable to the Building Commissioner for garbage dumpsters and receptacles so as to conceal the garbage dumpsters, receptacles and specific area used for garbage collection. Such enclosure shall have a gate or door which shall be kept closed at all times.
(b) The height of such enclosure shall extend one foot above the highest point of the dumpster. If the required height is in excess of that permitted by ordinance, the applicant will not be required to seek a variance from the Zoning Board of Appeals.
(c) The location of such dumpsters and receptacles shall be at a distance which is closer to the commercial building serviced by the dumpster than to any abutting residential dwelling.
(d) The hours for garbage collection from commercial property abutting residential property shall be limited to after 7:00 a.m. and before 6:00 p.m., Monday through Saturday.
(e) Whoever violates the provisions of this section is guilty of a misdemeanor of the third degree. Each day of violation of any provision of this section shall constitute a separate offense. (Ord. 55-2015. Passed 7-20-15.)
